1. Definitions

1.1 “We”, “our” and “us” means Apex Media Management FZCO (Company Number 34635 incorporated in the United Arab Emirates), with registered office at Apex Media Management FZCO, Dubai Silicon Oasis, DDP Building A1, Dubai, United Arab Emirates.

1.2 “User”, “Burster”, “buyer”, “customer”, “you” and “your” means anyone who accesses this website whether or not access results in an eventual purchase from a Distribution Party.

1.3 “Website” means all online content webpages owned and managed by us.

1.4 “Shipping Region” means the countries or regions to which shipping is available via the Distribution Party checkout for your selected delivery destination.

1.5 “Distribution Party” means the company that owns and operates the webpages where you place your final order, that you make payment to, and which is responsible for the sale, processing and dispatch of your purchased products.

2. Platform Operator and Distribution Party Relationship

2.1 We operate this Website as a marketing and information platform from the United Arab Emirates. We have a global visitor base and we do not customise or tailor this Website to meet the requirements of any specific country.

2.2 Our Website allows you to select products and build a cart. When you proceed to checkout, your cart is routed to a Distribution Party checkout based on the delivery destination you select.

2.3 The Distribution Party is the seller of record. Your purchase contract (including payment, fulfilment, dispatch, and sale terms) is made with the Distribution Party at their checkout and is governed by the Distribution Party’s Terms & Conditions and Privacy Policy shown on the checkout pages.

2.4 We provide customer service support for orders placed through our Website. We have access to order-related information to assist you with customer service (for example, order status, delivery updates, cancellations, and returns), where applicable.

3. Agreement

3.1 If you use our Website, you are agreeing to comply with and be bound by these Terms and Conditions, which together with our Privacy Policy govern our relationship with you (the “Agreement”). If you disagree with any part of these Terms and Conditions, please ensure that you do not use this Website.

3.2 You must be 18 years or over to make an order via our Website with a Distribution Party and have full legal capacity.

3.3 All sales are limited in terms of time and product availability, governed by the Distribution Party. Due to the nature of the products, whilst the Distribution Party will use their best endeavours to dispatch items within the indicated dispatch and shipping times, orders may sometimes take longer to ship. We will always be able to advise you of your order status, where applicable.

4. Placing an Order

4.1 To place an order, you must add selected products to your shopping cart on our Website and proceed to checkout on the Distribution Party website.

4.2 If you have a promotion code, or gift card, you can enter it at checkout (subject to the Distribution Party’s checkout rules).

4.3 You are responsible for reviewing your order details at checkout before completing payment. Once an order has been submitted and accepted, changes may not be possible.

4.4 All orders are subject to acceptance and availability at the sole discretion of the Distribution Party. The Distribution Party retains the right to cancel/reject orders in the case of item unavailability, incorrect pricing, if you are based outside the Shipping Region and/or your credit or debit card is not authorised for the transaction.

4.5 If an ordered item is unavailable, we will inform you as soon as practically possible. We will aim to let you know the next availability date. You retain the right to cancel the unavailable item upon notification via email, and where applicable we will action the cancellation and refund with the Distribution Party on your behalf.

4.6 This Website is for information purposes and for collecting products into your shopping cart. All shopping carts are electronically routed to the Distribution Party website for payment processing and onward fulfilment.

4.7 The checkout pages are on a separate website, owned and operated by the Distribution Party and governed by their own Terms & Conditions and Privacy Policy. You should ensure to read them before completing your order.

5. Pricing & Payment

5.1 Product prices displayed on our Website exclude shipping charges and any applicable taxes/fees that may be applied at the Distribution Party’s checkout. The final total cost will be displayed for your review and acceptance at checkout before you complete your order.

5.2 The Distribution Party reserves the right to change prices without notification at any time. You will be charged according to the price displayed at the time your order is placed at the Distribution Party checkout.

5.3 Payments are processed via a Secure Socket Layer (SSL) encrypted channel by an authorised third party appointed by the Distribution Party. At no time will your payment details be stored on our electronic system. Payment will be taken at the time of order acceptance by the authorised third party payment processor.

5.4 In the event that a payment cannot be processed, the order will not be accepted and will automatically be cancelled by the Distribution Party. In such an event, please contact us for further assistance.

5.5 Where applicable, taxes will be added by the Distribution Party at checkout and displayed for your review and acceptance before the payment is processed.

5.6 Your bank may or may not charge you processing fees for the transaction as per their policy and agreement with you. For any questions on bank fees, please contact your bank.

6. Order Processing & Communications

6.1 Order acceptance will be confirmed on screen by the Distribution Party. Order confirmation and order-related transactional emails (including dispatch confirmation) will be sent by the Distribution Party to the email address provided at checkout. We recommend that you retain these emails for your records.

6.2 Each order confirmation will contain an order number specific to your transaction that can be used in communications relating to that order.

6.3 Once an order has been accepted and payment has been successful, the order cannot usually be amended.

6.4 It is your responsibility to provide the correct email address upon placing an order. Neither we nor the Distribution Party can take responsibility for the non-delivery of emails to you should your email address be incorrect, or should a third party email server, or technical problem, prevent their delivery.

7. Shipping (General Information)

7.1 Dispatch and delivery timeframes vary by destination, shipping method, and Distribution Party. Any dispatch and shipping timeframes shown are estimates only.

7.2 By way of example only, many orders dispatch the same working day or the following working day, however dispatch times may be longer depending on stock availability, destination, peak periods, or other operational factors.

7.3 If you place an order that contains any item that is only available for pre-order, the whole order may be held until all items, including pre-order items, are available for shipping.

7.4 Shipping options may include tracked and non-tracked postal methods, and in some destinations a courier service may be available. Available options and pricing will be shown at checkout.

7.5 It is your responsibility to provide your full and correct shipping address at checkout. If your package is returned due to an incorrect or incomplete address, you may need to pay additional shipping costs to re-deliver your order to a corrected address.

7.6 If you are not present at the time of delivery, an “attempted delivery” note may be left asking you to contact your local postal office or courier directly to arrange re-delivery at a convenient time or to pick up your package in person from a specified location. Where a package is returned as “undeliverable”, refund handling will be in line with the Returns & Guarantee Policy in Section 8.

7.7 Please be aware that delays may be imposed by your country’s Customs clearance process. Any taxes or fees charged by your country’s Customs are the sole responsibility of the buyer.

7.8 By way of example only, a package may be treated as lost after it has been in the postal system for a period of over 20 working days and its location cannot be tracked. This period may be extended up to 30 working days in cases where we are aware of large scale postal disruptions. Exact thresholds and handling may vary by Distribution Party and destination.

7.9 For delivery issues, returns, defective/damaged/incorrect items, please refer to the Returns & Guarantee Policy in Section 8.

8. Returns & Guarantee Policy

This Returns & Guarantee Policy explains how returns, refunds, and our 30-Day Money-Back Guarantee work for orders placed through our Website.

8.1 Return & Guarantee Timeframes

8.1.1 You must contact us to request a return or guarantee claim within 30 days of the date your order is delivered (the “30-Day Period”).

8.1.2 If your return is approved, you must send the item(s) back within 14 days of receiving your return authorisation instructions (unless we instruct you not to return the product).

8.1.3 Any return made outside the timeframes above may not be accepted.

8.2 Standard Returns (Unopened / Unused Items)

8.2.1 Standard returns apply when you ordered the wrong product, changed your mind, or no longer need the item. Returned items must be in their original condition and packaging and unused. Under no circumstances should items be used.

8.2.2 We reserve the right to refuse a refund on any item which has been opened, damaged, dirtied, in un-saleable condition or which has not been returned in line with the specified returns procedure.

8.2.3 All standard returns are at your own expense.

8.2.4 If approved, you will receive a refund for the purchase price of the returned item(s). Shipping costs are excluded from refunds.

8.3 30-Day Money-Back Guarantee (Satisfaction Guarantee)

8.3.1 Within the 30-Day Period, if you are not satisfied, you may request a refund under this guarantee even if the product has been opened and reasonably tried, provided that your claim meets the conditions below.

8.3.2 To qualify for the Money-Back Guarantee, the product must have been used: (i) consistently in line with the recommended daily serving size / directions for use; and (ii) only to a reasonable extent for evaluation; and (iii) not excessively or in a way that goes beyond trying the product as intended.

8.3.3 If you purchase multiple units of the same product in one order, the Money-Back Guarantee applies to a maximum of one opened unit per product per order. Any additional units must be unopened and unused to be eligible for a refund. If multiple units are opened, we may limit or refuse Money-Back Guarantee refunds for those opened units.

8.3.4 Depending on the product type and safety/hygiene considerations, we may ask you to return the product (including any remaining product and original packaging), or instruct you not to return the item and instead provide information/photos and dispose of it. If we instruct you not to return the product, you must follow those instructions to remain eligible for a refund.

8.3.5 We reserve the right to limit Money-Back Guarantee claims in cases of suspected misuse, including repeated claims by the same customer/household, or claims inconsistent with reasonable trial or the multi-unit limit in Section 8.3.3.

8.3.6 Unless the item is confirmed as defective, damaged, or incorrect, return shipping for Money-Back Guarantee claims is at your own expense.

8.4 Defective, Damaged, or Incorrect Items

8.4.1 If your item arrives defective, damaged, or you receive the wrong item, contact us as soon as possible and within the 30-Day Period. We may request photos and/or additional information to help resolve the issue quickly.

8.4.2 If an item is confirmed defective, damaged, or incorrect, we may offer (at our discretion) a replacement, a refund (full or partial), or another appropriate remedy.

8.4.3 For confirmed defective, damaged, or incorrect items, we will provide an appropriate return process (which may include covering reasonable return shipping costs or providing an alternative process), unless we instruct you not to return the item.

8.5 Items Not Eligible for Refund

The following are not eligible for a refund: (i) items returned outside the timeframes in Section 8.1; (ii) items returned without following the returns/claims procedure; (iii) items returned opened/used under a standard return; (iv) items returned damaged, dirtied, or in an un-saleable condition (unless confirmed as defective/damaged/incorrect); (v) items used in a way that is inconsistent with reasonable trial for the Money-Back Guarantee, including excessive use or use that is not consistent with the recommended daily serving size/directions; (vi) Money-Back Guarantee claims on multiple opened units beyond the limit in Section 8.3.3.

8.6 How to Make a Return or Guarantee Claim

8.6.1 Contact our support team with your order number, the item(s) you want to return, the reason for the return/claim, and photos if the product is defective/damaged/incorrect (if applicable).

8.6.2 Return instructions and the return address will be provided in your return authorisation. The return address may also be stated on the note dispatched with your order.

8.6.3 We strongly advise returning items using tracked shipping as proof of return. If your returned items are not received, a refund cannot be processed unless you can provide proof of return.

8.7 Refund Processing

8.7.1 If your return or claim is approved, your refund will be processed within 30 days of receiving the returned goods, or within 30 days of approval if we instruct you not to return the item.

8.7.2 Refunds are issued to the original payment method where possible. Your bank or payment provider may take additional time to post the refund.

8.7.3 Shipping costs are excluded from refunds, except where we confirm the item is defective/damaged/incorrect or we have agreed to cover return shipping.

8.8 Customs Refusals / Rejected Deliveries (International Orders)

A refusal to pay for customs duties, clearance fees or taxes in your country—and therefore a rejection of the order initiated by you—will be treated as a customer-initiated return. All associated costs to return the order will be at your own expense, and any refund will be reduced by any costs incurred in recovering/returning the shipment.

8.9 Our Right to Refuse Returns

We reserve the right to refuse a refund where items are not returned in line with this policy and the specified returns procedure, including where items are opened/used under a standard return, returned in an un-saleable condition, returned outside the defined timeframes, where proof of return cannot be provided for missing returns, or where the Money-Back Guarantee is used in a way that is inconsistent with reasonable trial or the multi-unit limits in Section 8.3.3.

If you purchase multiple units of the same product, we recommend trying one unit first before opening others.

9. Promotion Codes

9.1 If you have opted-in to receive information on our products, you may occasionally receive promotion codes or product newsletters from us by e-mail.

9.2 Promotion codes can be applied at the Distribution Party’s checkout.

9.3 Promotion codes have no monetary value and under no circumstances can they be converted into currency. Each code has an expiry date set at our discretion. We reserve the right to modify the expiry date without notification.

9.4 Promotion codes cannot be divided into parts. The discount achieved by the use of a promotion code must not exceed the total monetary value of the order (excluding shipping costs).

9.5 Some promotion codes will specify a minimum amount to be spent in order to be applied.

9.6 Promotion codes cannot be applied past their expiry dates.

9.7 Any refund made on an order where a promotion code was applied will be reduced by the discounted amount.

9.8 Only one promotion code can be used per order.

10. Subscribe & Save

10.1 Definitions

“Subscribe & Save” is a feature made available via the Distribution Party that gives you the possibility to set up recurring orders to be automatically processed and shipped at a predefined frequency.

A “Subscription” holds the instructions necessary for a set of orders to be automatically processed and shipped at a predefined frequency. You can have multiple Subscriptions.

A “Recurring Order” is an order that is placed automatically as part of an existing Subscription.

The “Initial Order” is the order used to set up a Subscription.

The “Subscription Frequency” is the time interval you choose between Recurring Orders.

A “One-Time Purchase” product is one that will not be added to a Subscription.

10.2 Subscribe & Save is operated by the Distribution Party. The Initial Order will be processed and shipped by the Distribution Party in the same way as a standard order. The Subscribe & Save products in the Initial Order will be set up into a Subscription that will subsequently be processed and shipped again according to your selected Subscription Frequency.

10.3 All One-Time Purchase products will be processed and shipped only once by the Distribution Party, even if combined with Subscribe & Save products on the Initial Order. All Subscribe & Save products will be processed and shipped with the Initial Order and thereafter automatically as part of a Subscription according to your selected Subscription Frequency.

10.4 With Subscribe & Save you may be entitled to a discount. Any Subscribe & Save discount, pricing, and terms are determined by the Distribution Party and may vary from time to time. The applicable discount (if any) will be shown at checkout and/or in the Distribution Party’s order communications.

10.5 The payment method and details used to place the Initial Order (that sets up your Subscription) will be the default payment method and details used for all subsequent Recurring Orders, unless and until:
- the Subscription is cancelled; or
- the payment method or details expire; or
- you modify the payment method or details (in accordance with the Distribution Party’s processes).

10.6 You will be charged on the day a Recurring Order is processed by the Distribution Party. If your payment method or details are declined at the time a Recurring Order is processed, the Recurring Order will not be successful and will not be shipped. You will be notified of the failed transaction and given assistance on how to update your payment method and details if this is required. Payment processing may be retried in accordance with the Distribution Party’s processes. Accepted payment methods (including whether gift cards are accepted) are determined by the Distribution Party and will be displayed at checkout.

10.7 You may cancel your Subscription at any time after the first Recurring Order. Cancellation will prevent future Recurring Orders from being processed. Recurring Orders that have already been processed cannot be cancelled and will be handled in line with the applicable Returns & Guarantee Policy.

10.8 Transactional email notifications related to your Subscription and Recurring Orders will be sent by the Distribution Party to the email address provided at checkout.

10.9 If any product in your Subscription is out of stock at the time a Recurring Order is processed, it will be removed from the order. Other products in the Recurring Order will be shipped as normal. If all products in a Recurring Order are out of stock, then the order will be cancelled. You will not be charged for any non-shipped items.

10.10 You can pause a Subscription at any time. This will prevent any subsequent Recurring Orders being processed from that Subscription while it is paused. Paused Subscriptions can be resumed at any time. Cancelled Subscriptions can be reactivated.

10.11 You can edit the settings of your Subscription at any time in accordance with the Distribution Party’s processes and available functionality.

10.12 The Distribution Party reserves the right to make changes to any available products at any time. If a product undergoes any change, this change will also be reflected in the Subscription. Changes may include price, fill quantity, formulation, and other product attributes. You may be notified in advance of product changes so that you can edit, pause or cancel your Subscription should you wish to. If no change is made to your Subscription, this means that you agree with the product change and agree to keep it in your Subscription with the new change.

10.13 Subscribe & Save discounts cannot be combined with any other offers, coupons or sales unless stated at checkout by the Distribution Party.

10.14 The Distribution Party reserves the right to pause, terminate or modify any Subscription, the Subscribe & Save functionality overall and on any individual product, and offered discounts, at any time, for any reason and without prior notice.

11. Website Content & Access

11.1 The Website is undergoing continuous enhancements which may be made public at any time. Information is subject to change without notice.

11.2 Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. We aim to represent product images as accurately as possible; however, variations are to be expected.

11.3 We aim to achieve uninterrupted access to the Website; however, this may be suspended, restricted or terminated at any time.

11.4 From time to time, this Website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse these other websites. We have no responsibility for the content of linked websites. These websites are governed by their own Terms and Conditions and Privacy Policies.

11.5 All information provided on our Website is for information and educational purposes only, and does not substitute for professional medical advice. If you’re seeking medical advice, diagnoses, or treatment, you must consult a medical professional or your healthcare provider. Your use of any information or materials on this Website is entirely at your own risk, for which we shall not be liable. 12.1 You will only own purchased items upon successful dispatch and when successfully paid for in full to the Distribution Party through their website.

12.2 All products on our Website are strictly not for re-sale.

13. Liability

13.1 We do our best to keep information secure, but in the absence of our sole negligence we cannot be held liable for any loss you may suffer if a third party obtains unauthorised access to any data you provide when using our Website.

13.2 We shall not be liable to you in connection with these Terms and Conditions in contract, tort (including negligence) or otherwise for any loss, any internet, network or virus problem, for any loss of profit, anticipated savings or data (in each case whether direct or indirect) and/or any indirect loss.

13.3 Our aggregate liability to you in connection with these Terms and Conditions shall not exceed the value of the goods ordered by you.

14. Statutory Rights

14.1 These Terms and Conditions do not affect your statutory rights as a consumer.

15.1 We reserve the right to change the Terms and Conditions at any time.
